These Terms and Conditions ("Terms") govern the use of the ArtSigna platform ("Platform") provided by Grupo Larrosa OÜ ("Provider"). By accessing or using the Platform, you ("User") agree to these Terms.

Registering on the Platform implies immediate and unconditional acceptance of these Terms and Conditions. Consequently, the User declares to have read and fully accepted these Terms and Conditions; such acceptance is essential for using the Platform. If you do not agree, you will not be able to access it.

At ArtSigna, we offer a service for registering compositions and recordings on the Bitcoin blockchain to ensure the security and integrity of your records. These services may include the following features:
  1. 1.1 Authorship Registration in Our Database:

    Musical works can be registered and recorded in our databases and computer systems. ArtSigna operates as a digital repository, providing reliable evidence of the authorship and ownership of the works, as well as their content and details, serving as proof of existence.

  2. 1.2 Security and Authenticity:

    The integrity and authenticity of the registered information are guaranteed through the use of public key technology, including the generation of cryptographic hashes for work identification and timestamping to verify the registration date and any subsequent annotations.

  3. 1.3 Blockchain Integration:

    Registration evidence (digital fingerprints) is integrated into a file that is automatically recorded on the Bitcoin blockchain. This adds an additional layer of traceability, guarantee, and publicity to registration operations.

  4. 1.4 Issuance of Registration Certificates:

    We issue registration certificates that certify the authorship, ownership, and timestamp of the registered works. These certificates can serve as documentary evidence if necessary, certifying this information and the registration date and time in ArtSigna.

  1. 2.1 The User must be over 18 years old and fully capable. Otherwise, they must provide specific authorization from a legal representative to use the Platform's services. In the case of legal entities, the User must have a special power of attorney and ensure that the legal entity is legally constituted, registered, active, and in compliance with all its obligations in the relevant public records, agencies, and authorities required for its activities.
  2. 2.2 The User guarantees the authenticity and ownership of the information provided for registration, ensuring that all provided information, including any attached data or files, is truthful, correct, complete, current, and lawful. Creating an account with false, outdated, or third-party information, especially infringing on intellectual property rights, privacy, honor, intimacy, image rights, confidentiality, or constitutes a crime, implies a serious breach of these conditions.
  3. 2.3 The User must understand that they assume full responsibility for the accuracy and rights of the provided information. The Platform does not endorse or control the content provided by the user and accepts no responsibility related to it. User-Generated Content sent through the Site is not necessarily reviewed by the Platform before publication and does not necessarily reflect its opinions or policies.
  4. 2.4 The User agrees to indemnify and hold harmless the Provider against any claims for copyright infringement, privacy violation, or any other dispute related to the registered content. This includes, but is not limited to, legal costs and damages.

At ArtSigna, we are committed to providing a safe and respectful environment for all our users. By using our platform, you agree to comply with the following rules of permitted use:

  1. 3.1 The platform is designed for personal and non-commercial use. Using the site for commercial purposes without our prior written authorization is not allowed.

  2. 3.2 By registering on ArtSigna and using our services, you agree to provide truthful, accurate, and complete information. Impersonating another person or entity, or falsifying your identity in any way, is not permitted.

  3. 3.3 You declare and guarantee that you are the legitimate owner or have the necessary rights to register the musical works on our platform. Registering works that infringe the intellectual property rights of third parties is not allowed.

  4. 3.4 You must use the platform ethically and respectfully. This includes, but is not limited to: (i) Not using the site for any illegal or unauthorized activity, (ii) Not sending, uploading, or distributing content that is defamatory, offensive, harassing, abusive, obscene, or that infringes the privacy rights of other users, (iii) Not using the site to transmit viruses, malware, or any other malicious code.

  5. 3.5 Actions that may damage, disable, overload, or impair the functionality of the platform are not allowed.

  1. 4.1 The Platform and its content are the exclusive property of Grupo Larrosa OÜ, which has the corresponding authorization for its use and licensing. This includes, but is not limited to, images, photographs, designs, graphics, sounds, data compilations, trademarks, names, titles, designations, distinctive signs, and all other material accessible through the Platform.

  2. 4.2 The Platform reserves all rights to its content, and it does not grant or transfer anyintellectual property rights to the User.

  3. 4.3 The intellectual property rights of works registered on the Platform belong to their authors or, where applicable, to those to whom the authors have assigned their rights.

  4. 4.4 Registration on the Platform does not grant rights to those who consult the records. Exploitation of the works always requires the consent of their respective owners.

Fees may be one-time or recurring, detailed in the Platform's Invoices & Credits section. Any changes to the fees will be notified to the User 30 days in advance via an announcement on the Platform.

  1. 6.1 These Terms are governed by the laws of Spain, regardless of conflict of law principles.

  2. 6.2 Each party irrevocably agrees that any legal action or proceeding arising from or related to these Terms will be brought, determined, and finally resolved by the International Commercial Arbitration Court under the European Arbitration Chamber (Belgium, Brussels, Avenue Louise, 146). The number of arbitrators will be one. The legal seat or place of arbitration will be Madrid, Spain. The language to be used in the arbitration proceedings will be Spanish.

  3. 6.3 Each party irrevocably submits to the exclusive jurisdiction of such courts unconditionally regarding any such action or proceeding. Each party agrees not to initiate any action, suit, or proceeding related thereto except in the courts described above, and irrevocably and unconditionally waives and agrees not to assert, by way of motion or defense, counterclaim, or otherwise, in any such action or proceeding arising out of or relating to these Terms.

The content of this website and these Terms and Conditions are subject to change and updates by the Platform at any time without prior notice. YOU MUST REVIEW THESE TERMS AND CONDITIONS FROM TIME TO TIME TO BE AWARE OF ANY CHANGES MADE. Your continued use of the Platform constitutes your acceptance of any changes or updates.

At ArtSigna, we are committed to protecting the privacy and security of our users' personal data. This privacy policy describes how we collect, use, and protect your personal information when you use our platform to register musical works.
  1. 8.1 Personal Data We Collect: (i) Contact information (name, email address, phone number, etc.), (ii) Work registration information (details of the composition and recording, authorship, ownership, percentage, etc.), (iii) Payment information (credit card or bank account details), (iv) Public registration information (author's name and work title).
  2. 8.2 Collection Methods: We collect personal data directly from you when: (i) You register on our platform, (ii) you register a musical work, or (iii) you communicate with us via email, phone, or other contact channels.
  3. 8.3 We use your personal data to: (i) Provide and manage our musical work registration services, (ii) Issue registration certificates, (iii) Improve and personalize your experience on our platform, (iv) Communicate with you about updates, service changes, and promotions, (v) allow public consultation of the author’s name and the title of the work in our publicly accessible database to ensure transparency and traceability of registrations.
  4. 8.4 We process your personal data based on your consent, the need to execute a contract, compliance with legal obligations, and our legitimate interest in improving our services. Confidential Information may only be disclosed in response to a valid order from a court or other governmental body, but only to the extent and for the purposes of such order.
  5. 8.5 We implement appropriate technical and organizational security measures to protect your personal data against unauthorized access, loss, destruction, or alteration. These measures include using public key technology, generating cryptographic fingerprints for work, and recording registrations.
  6. 8.6 Work and recording registration data is stored on secure servers and integrated into the Bitcoin blockchain, adding an additional layer of traceability and authenticity.
  7. 8.7 We do not share your personal data with third parties except when necessary to fulfill the registration purpose, comply with our legal obligations, and/or when you have given explicit consent.
  8. 8.8 We retain your personal data for as long as necessary to fulfill the purposes for which it was collected, comply with legal obligations, resolve disputes, and enforce our agreements.
  9. 8.9 The author's name and the work's title will be included in a public consultation database accessible from our platform. This database ensures the transparency and authenticity of musical work registrations.

ArtSigna strives to offer high-quality services and maintain a safe and functional environment for registering musical works on the Bitcoin blockchain. However, users must understand the scope and limitations of our responsibility. By using our platform, you agree to the following provisions:
  1. 9.1 ArtSigna services are provided "as is" and "as available." We do not guarantee that our services will be error-free, uninterrupted, delayed, data loss-free, or free from any other issues related to the platform's use.
  2. 9.2 While we strive to ensure the accuracy and reliability of the information provided on our platform, we do not guarantee the accuracy, completeness, or timeliness of such information. Users are responsible for verifying the accuracy of the entered and registered data.
  3. 9.3 To the fullest extent permitted by applicable law, ArtSigna, its directors, employees, agents, suppliers, and partners will not be liable for: Direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses resulting from the use or inability to use our services. Damages resulting from any unauthorized access to or alteration of your transmissions or data.
  4. 9.4 We are not responsible for interruptions, technical failures, or any other incident that may affect the platform's availability or functionality. This includes issues related to technological infrastructure, cyberattacks, network failures, scheduled maintenance, or any other event beyond our control.
  5. 9.5 Our platform may contain links to third-party websites or services that are not under our control. We are not responsible for the content, accuracy, privacy policies, or practices of third-party websites or services. You access these links at your own risk.
  6. 9.6 We reserve the right to modify, suspend, or discontinue any part of ArtSigna services at any time without prior notice. We will not be liable for any modification, suspension, or discontinuation of our services.
  7. 9.7 Although we use the Bitcoin blockchain to ensure the immutability and authenticity of records, we are not responsible for inherent issues with blockchain technology, such as forks, network changes, or any other circumstance that may affect the Bitcoin blockchain's operation.
  8. 9.8 You agree to indemnify and hold harmless ArtSigna, its directors, employees, agents, and partners from any claim, demand, damage, loss, or expense, including reasonable attorney fees, arising from your use of the platform, your breach of these terms and conditions, or your violation of any third-party rights.
  9. 9.9 We do not assume any responsibility for intervening in disputes between users or between users and third parties. By using our platform, you agree to be solely responsible for your interactions and transactions with other platform users or third parties.
  10. 9.10 THE PLATFORM DOES NOT COLLECT ROYALTIES FOR THE REGISTERED MUSICAL WORKS NOR ACTS AS AN INTERMEDIARY IN COPYRIGHT MANAGEMENT. IN ADDITION, REGISTRATION ON ARTSIGNA DOES NOT REPLACE OFFICIAL REGISTRATIONS THAT MAY BE REQUIRED BY COPYRIGHT OFFICES IN EACH COUNTRY.

By registering and using the Platform, the User confirms having read, understood, and accepted these Terms and Conditions.
